These Terms of Service (Terms) govern your access to and use of the TTN Voice Receptionist platform, including our website, applications, voice gateway, and any related services (collectively, the Service). The Service is provided by the operator of Tradies Network (TTN, we, us) and these Terms apply if you access the Service from within Australia.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law which cannot be lawfully excluded.
1. Acceptance of these Terms
By creating a TTN account or using the Service, you accept these Terms. If you are accepting these Terms on behalf of a business or other entity, you represent that you have the authority to bind that entity, and references to you include that entity.
2. Your account
You must provide accurate, current and complete information when you sign up, and you must keep that information current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
You must be at least 18 years old, or otherwise legally capable of entering into a contract, to use the Service.
3. The Service
TTN provides an AI receptionist service that answers inbound calls on your behalf, captures job details, books work, sends SMS summaries to you, and forwards photos and other attachments from your customers. The exact features available to you depend on your plan.
We may update, change or remove features of the Service from time to time. Where a change is material and to your detriment, we will give you reasonable notice.
4. Your phone number, telephony, and SMS
You authorise TTN to provision telephone numbers, route calls, receive and send SMS messages, and otherwise operate telephony services on your behalf for the purpose of providing the Service. Where you elect to keep your existing number, you authorise us to configure call forwarding or other routing as required.
You are responsible for ensuring that any telephone numbers you connect to TTN are numbers you are entitled to use, and that your use of the Service complies with the Telecommunications Act 1997 (Cth), Spam Act 2003 (Cth), Do Not Call Register Act 2006 (Cth) and any applicable industry codes (including the Telecommunications Consumer Protections Code).
5. Fees, billing and trials
Some plans include a free trial. After the trial, the Service is billed in advance on a recurring basis according to the plan you select. All fees are stated in Australian dollars and are inclusive of GST unless otherwise stated.
You authorise us (or our payment processor) to charge your nominated payment method for all fees, taxes and other amounts that become payable. If a payment fails, we may suspend the Service until payment is received.
6. Your data and customer recordings
The Service involves the recording of telephone conversations between TTN and your customers. You are responsible for ensuring that the recording, storage and use of those conversations complies with applicable Australian law, including state-level surveillance and listening device legislation, and that your customers are notified and (where required) consent to the recording.
Our handling of personal information collected through the Service is described in our Privacy Policy (AU).
7. Acceptable use
You must not use the Service to engage in any activity that is unlawful, fraudulent, abusive, harassing, defamatory, or that infringes the rights of any person. A full list of prohibited uses is set out in our Acceptable Use Policy, which forms part of these Terms.
8. Service availability
We will use commercially reasonable efforts to make the Service available. The Service may be unavailable from time to time for maintenance, upgrades, or due to factors outside our control (including telecommunications carrier outages, third-party AI service outages, or force majeure events).
9. Intellectual property
The Service, including all software, content, branding and documentation, is and remains the property of TTN and its licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
You retain ownership of content you submit to the Service (including call recordings, transcripts, customer details and photos). You grant TTN a worldwide, royalty-free licence to host, process, transmit and display that content solely as required to provide the Service.
10. Your obligations to your customers
You are responsible for the quality and timeliness of the work you perform for your customers, and for any commitments you make to your customers (directly or through TTN). TTN is not a party to any agreement between you and your customer.
11. Consumer guarantees and limitation of liability
Where the Australian Consumer Law applies, you may have rights and remedies in addition to those set out in these Terms. Those rights cannot be excluded.
To the maximum extent permitted by law, and except for liability that cannot lawfully be excluded:
- our liability to you for breach of any consumer guarantee in respect of services is limited (at our option) to supplying the services again or paying the cost of having the services supplied again;
- we are not liable for any indirect, incidental, special or consequential loss or damage, or for loss of profit, revenue, data, goodwill or business opportunity; and
- our total aggregate liability arising out of or in connection with the Service is capped at the fees you paid us in the 12 months preceding the event giving rise to the liability.
12. Termination
You may cancel your account at any time from the Service. We may suspend or terminate your access if you materially breach these Terms, if your account is more than 30 days in arrears, or as required by law.
On termination, your right to use the Service ends. We will retain and delete your data in accordance with our Privacy Policy and any applicable record-keeping obligations.
13. Changes to these Terms
We may update these Terms from time to time. For material changes we will give you reasonable notice (typically by email or in-product notice) before the change takes effect. Continued use of the Service after the effective date means you accept the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and TTN submit to the exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from those courts.
